These Terms of Use ("Terms") govern your access to and use of the website located at https://factscholarship.org and any related pages, features, content, services, and donation functionality (collectively, the "Website"). The Website is operated by Funding Aspiring Career Training (F.A.C.T.), a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, with EIN 87-0911768 ("F.A.C.T.," "we," "us," or "our").
By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Website.
1. Purpose of the Website
F.A.C.T. operates the Website to provide information about its mission, vocational scholarship activities, participating schools, charitable programs, and opportunities to support vocational education.
The Website is intended for lawful informational, charitable, and donation-related purposes. F.A.C.T. does not guarantee that any particular scholarship, financial assistance, school placement, employment opportunity, or other benefit will be available to any person.
2. Eligibility and Authorized Use
You may use the Website only if you can legally enter into a binding agreement under applicable law. If you are under the age of 18, you may use the Website only with the involvement and consent of a parent or legal guardian.
You agree to use the Website in compliance with these Terms and all applicable federal, state, local, and international laws and regulations.
3. Donations
Donations made through the Website are voluntary charitable gifts to F.A.C.T. and are not purchases of goods or services. Unless expressly stated otherwise, donors do not receive goods, services, merchandise, or other consideration in exchange for their donations.
Donations are intended to support F.A.C.T.'s charitable and educational purposes, including vocational scholarships and related assistance for eligible students. F.A.C.T. may use unrestricted donations in its discretion to support its charitable mission and current organizational needs.
A donor may request that a contribution support a particular program or purpose. F.A.C.T. will consider such requests but may be unable to honor a restriction or designation. If F.A.C.T. cannot reasonably use a restricted gift for its designated purpose, it may use the gift for a substantially similar charitable purpose to the extent permitted by law.
Donations are tax-deductible only to the extent permitted by applicable law. Donors are responsible for determining the tax treatment of their contributions and should consult their own tax advisors. F.A.C.T. does not provide tax, legal, or accounting advice.
F.A.C.T. will provide donation acknowledgments or receipts as appropriate. Donors should retain their payment records and any acknowledgment provided by F.A.C.T. for their records.
4. Donation Processing and Third-Party Payment Services
Online donations may be processed through Stripe or another third-party payment service identified on the applicable donation page. When you submit a donation through a third-party payment page, your transaction may also be subject to that provider's terms of service, privacy policy, security practices, and other terms.
F.A.C.T. does not control third-party payment platforms and is not responsible for their independent policies, systems, availability, security practices, processing errors, or acts or omissions, except to the extent liability cannot be excluded under applicable law.
You represent that you are authorized to use the payment method submitted for a donation. You agree to provide accurate and complete payment and contact information and to promptly update any information that changes.
Donation reversals, chargebacks, refunds, and payment disputes may be subject to the applicable donation policy and the rules of the payment processor. F.A.C.T. may investigate suspected fraudulent, unauthorized, or improper transactions and may take appropriate action, including contesting an improper chargeback where permitted by law.
5. No Goods or Services
The Website does not offer goods or services for sale unless a particular page expressly states otherwise. Donations are charitable contributions and are not payments for merchandise, admission, tuition, employment, scholarship approval, or any other guaranteed benefit.
Information about vocational training programs, participating schools, scholarship opportunities, or potential career outcomes is provided for general informational purposes only. F.A.C.T. does not guarantee admission to any school, completion of any program, licensure, certification, employment, income, or career outcome.
6. Scholarship Information
Information concerning scholarships, eligibility, application procedures, participating schools, deadlines, and award decisions may change without notice.
Submitting an inquiry, application, message, or other information to F.A.C.T. does not guarantee that an applicant will receive funding or be selected for a scholarship. Scholarship decisions are subject to F.A.C.T.'s applicable procedures, available funds, eligibility requirements, and legal obligations.
Applicants and their parents or legal guardians, where applicable, are responsible for reviewing all scholarship requirements and submitting accurate, complete, and timely information.
7. Third-Party Websites and Services
The Website may contain links to third-party websites, services, or resources, including donation pages operated by Stripe and websites or information relating to partner schools such as Lincoln Tech.
These links are provided for convenience and informational purposes. A link does not necessarily constitute an endorsement, sponsorship, recommendation, or guarantee by F.A.C.T. of the third party, its products, services, content, policies, programs, or practices.
F.A.C.T. does not control or assume responsibility for third-party websites or services. Your use of third-party websites and services is governed by the applicable third party's terms and policies. You access third-party websites and services at your own risk.
8. Intellectual Property Rights
The Website and its content, including text, articles, photographs, graphics, designs, logos, trademarks, service marks, videos, audio, software, layout, and other materials, are owned by or licensed to F.A.C.T. and are protected by applicable intellectual property laws.
"Funding Aspiring Career Training," "F.A.C.T.," related names, logos, slogans, designs, and service marks are trademarks or identifying marks of F.A.C.T. or their respective owners. You may not use them without prior written permission.
F.A.C.T. grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Website for personal, noncommercial, lawful purposes. This limited permission does not transfer ownership or any other intellectual property rights to you.
Except as expressly permitted by applicable law or in writing by F.A.C.T., you may not:
- Copy, reproduce, modify, distribute, publish, display, perform, sell, license, or exploit Website content;
- Create derivative works from the Website or its content;
- Use Website content for commercial purposes;
- Remove copyright, trademark, attribution, or other proprietary notices;

- The Submission does not contain malicious code, viruses, or harmful material; and
- The Submission does not contain confidential information that you do not want F.A.C.T. to receive.
You retain ownership of your Submission. By providing a Submission, you grant F.A.C.T. a non-exclusive, worldwide, royalty-free license to use, reproduce, store, process, and disclose the Submission as reasonably necessary to respond to you, administer F.A.C.T.'s programs, operate the Website, comply with law, and carry out F.A.C.T.'s charitable purposes.
F.A.C.T. will handle personal information as described in its Privacy Policy. Do not submit sensitive personal information through the Website unless specifically requested through an authorized and secure process.
10. Prohibited Conduct
You may not use the Website to:
- Violate any applicable law, regulation, or legal obligation;
- Infringe, misappropriate, or violate the rights of F.A.C.T. or any other person;
- Submit false, misleading, fraudulent, or deceptive information;
- Impersonate another person or organization;

- Interfere with or disrupt the Website, its servers, networks, or security features;

F.A.C.T. may investigate suspected violations and may suspend, restrict, or terminate access to the Website, reject transactions, or take other appropriate action, subject to applicable law.
11. Accuracy of Information
F.A.C.T. seeks to provide useful and accurate information, but Website content may contain errors, omissions, outdated information, or typographical mistakes. Information may be changed, corrected, or removed at any time without notice.
F.A.C.T. does not warrant that Website content is complete, current, accurate, or suitable for any particular purpose. You are responsible for independently confirming information before relying on it.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT, FEATURES, AND SERVICES MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, F.A.C.T. DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
F.A.C.T. DOES NOT WARRANT THAT:
- THE WEBSITE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- THE WEBSITE OR ITS SERVERS WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
- DEFECTS OR ERRORS WILL BE CORRECTED;
- THE WEBSITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
- INFORMATION PROVIDED THROUGH THE WEBSITE WILL BE COMPLETE, CURRENT, OR RELIABLE; OR
- ANY DONATION, SCHOLARSHIP, PROGRAM, SCHOOL PLACEMENT, OR OTHER RESULT WILL BE AVAILABLE OR PROVIDED.
Some jurisdictions do not permit the exclusion of certain implied warranties. To the extent those laws apply, some of the exclusions above may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, F.A.C.T. AND ITS DIRECTORS, OFFICERS, TRUSTEES, EMPLOYEES, VOLUNTEERS, AGENTS, REPRESENTATIVES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATED TO:
- YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE;
- WEBSITE CONTENT or reliance on information provided through the Website;
- DONATION PROCESSING, PAYMENT FAILURES, CHARGEBACKS, OR REFUNDS;
- THIRD-PARTY WEBSITES, PAYMENT SERVICES, OR OTHER THIRD-PARTY CONTENT;
- UNAUTHORIZED ACCESS, USE, ALTERATION, OR DISCLOSURE OF YOUR INFORMATION;
- ANY SCHOLARSHIP APPLICATION, AWARD, DENIAL, PROGRAM, OR SCHOOL-RELATED MATTER; OR
- ANY OTHER MATTER RELATING TO THE WEBSITE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF F.A.C.T. AND THE OTHER PERSONS IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS (US $100); OR (B) THE AMOUNT YOU PAID DIRECTLY TO F.A.C.T. THROUGH THE WEBSITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
The limitations in this Section do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, gross negligence, or other liability that applicable law does not permit to be limited.
14. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless F.A.C.T. and its directors, officers, trustees, employees, volunteers, agents, representatives, contractors, service providers, and affiliates from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your access to or use of the Website;
- Your violation of these Terms;
- Your violation of any applicable law or third-party right;
- Your Submission or other content provided by you;
- Your fraudulent, unauthorized, or improper donation or payment activity; or
- Your use of a third-party website or service linked through the Website.
F.A.C.T. reserves the right to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with F.A.C.T.'s defense of such claims.
15. Privacy
Your use of the Website is also governed by F.A.C.T.'s Privacy Policy, which describes how F.A.C.T. may collect, use, disclose, and protect personal information.
By using the Website, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure. You should avoid submitting unnecessary sensitive information through the Website.
16. Copyright Complaints
If you believe that material on the Website infringes your copyright, please send a written notice to info@factscholarship.org containing:
- Identification of the copyrighted work allegedly infringed;
- Identification of the material allegedly infringing and information sufficient to locate it;
- Your contact information;
- A statement that you have a good-faith belief that the use is unauthorized; and
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
F.A.C.T. may remove or restrict access to allegedly infringing material and may take other appropriate action.
17. Suspension and Termination
F.A.C.T. may modify, suspend, or discontinue the Website, any feature, or any content at any time, with or without notice.
F.A.C.T. may suspend or terminate your access to the Website if it reasonably believes that you have violated these Terms, applicable law, or the rights of another person, or if suspension or termination is necessary to protect the Website, F.A.C.T., its users, donors, applicants, or others.
Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, donations, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.
18. Changes to These Terms
F.A.C.T. may update or amend these Terms from time to time. The updated version will be posted on the Website with a revised effective date.
Unless otherwise required by applicable law, changes become effective when posted. Your continued access to or use of the Website after the effective date of revised Terms constitutes your acceptance of the changes.
If you do not agree to revised Terms, you must stop using the Website.
19. Governing Law and Venue
These Terms and your use of the Website are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
To the extent permitted by law, any legal action or proceeding arising out of or relating to these Terms or the Website must be brought in the state or federal courts located in Nassau County, New York, and you consent to the jurisdiction and venue of those courts.
Nothing in this Section prevents F.A.C.T. from seeking temporary, preliminary, or injunctive relief in any court with appropriate jurisdiction or limits rights that cannot lawfully be waived.
20. Severability
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and will be modified or severed only to the extent necessary. The remaining provisions will remain in full force and effect.
21. No Waiver
F.A.C.T.'s failure to enforce any provision of these Terms does not constitute a waiver of that provision or F.A.C.T.'s right to enforce it later.
22. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and F.A.C.T. concerning your use of the Website and supersede prior or contemporaneous understandings concerning that subject matter.
Additional terms may apply to specific services, donation pages, scholarship programs, applications, or third-party services. If there is a conflict between these Terms and a specific written agreement or program terms, the specific terms will control to the extent of the conflict.
23. No Agency or Beneficiary Rights
These Terms do not create a partnership, joint venture, agency, employment, fiduciary, or other similar relationship between you and F.A.C.T.
No person who is not a party to these Terms is intended to receive or enforce any right or benefit under these Terms, except for the F.A.C.T. persons and entities expressly protected by the indemnification and limitation-of-liability provisions.
